Returns, Cancellations and Refund Policy

This Returns, Cancellations and Refund Policy applies to purchases made online from Bismillah Gift Centre.
Nothing in this policy limits or excludes any rights available to consumers under applicable UK consumer law.

Please contact us before returning an item so that we can provide the appropriate return instructions and identify your order correctly.
Customers are not legally required to use a particular cancellation form. However, contacting us before sending a return helps us process it efficiently.
2. Your Right to Cancel an Online Order
For most goods purchased online, you have the right to cancel your order without giving a reason.
You must inform us that you wish to cancel within 14 days after the day on which you, or a person nominated by you, receives the goods.
Where an order contains multiple goods delivered separately, the cancellation period normally begins after the final item is delivered.
After informing us that you wish to cancel, you must return the goods without unnecessary delay and no later than 14 days after the day on which you informed us of your cancellation.

3. Condition of Change-of-Mind Returns
You may inspect a product in the same way that you reasonably would in a physical retail store.
Where possible, returned products should include:

The original product;

All accessories, components and instructions;

Tags, labels and seals that have not reasonably needed to be removed;

The original packaging, where available; and
-
Your order confirmation, receipt or other reasonable proof of purchase.
Opening packaging will not automatically prevent a return where opening it was reasonably necessary to inspect the product.
You are responsible for taking reasonable care of the goods while they are in your possession.
4. Diminished Value and Excessive Handling
We do not apply an automatic restocking or administration fee to statutory consumer cancellations.
However, where a product has been handled beyond what is reasonably necessary to establish its nature, characteristics and functioning, and that handling has caused an actual reduction in its value, we may make a reasonable and proportionate deduction from the refund.
Any deduction will be based on the demonstrable reduction in the product’s value and will not automatically be calculated as a fixed percentage.
Examples of excessive handling may include:

Using cookware to prepare food;

Installing or extensively operating an electrical appliance;

Scratching, staining or damaging the product;
-
Returning incomplete products;
-
Removing protective materials unnecessarily;
-
Returning goods with missing accessories or components; or
-
Handling the item in a way that prevents it from being resold as new.
We will explain the reason for any proposed deduction.
No deduction will be imposed merely because packaging has been opened where opening it was reasonably necessary to inspect the item.
5. Return Postage for Change-of-Mind Returns
For a return arising solely because you changed your mind, you are responsible for the direct cost of returning the goods to us.
We recommend using an appropriately insured and trackable delivery service. You remain responsible for the returned goods until they are delivered to us.
We do not accept responsibility for goods that are lost or damaged while being returned by a service arranged by the customer.
If an item cannot normally be returned by post because of its size, weight or nature, please contact us before returning it. Any direct return cost will be communicated where reasonably possible.
6. Original Delivery Charges
Where you validly cancel the entire order under your statutory cancellation right, we will refund the cost of our least expensive standard delivery option offered for that order.
If you selected an enhanced, express or more expensive delivery option, we are not required to refund the additional amount above the cost of standard delivery.
Where only part of an order is returned, the original delivery charge may not be refundable where that delivery charge would have been payable for the retained items in any event.
7. Refund Processing
Once we receive the returned goods, or acceptable evidence that they have been sent back, we will inspect and process the return.
Subject to any lawful deduction, refunds will be issued without unnecessary delay and no later than 14 days after the earliest of:

The day on which we receive the returned goods; or

The day on which you provide acceptable evidence that the goods have been returned.
Refunds will normally be made using the original payment method unless another method has been expressly agreed.
After we issue the refund, your bank, card provider or payment provider may require additional processing time before the funds appear in your account.

8. Faulty, Damaged, Incorrect or Misdescribed Goods
Please inspect your order as soon as reasonably possible after delivery.
Contact us promptly if:

The product is faulty;

The product was damaged when delivered;
-
You received the incorrect product;
-
An item is missing from the order;
-
The product is materially different from its description; or
-
The product is not fit for its normal or agreed purpose.

Clear photographs or video where reasonably requested; and

Photographs of the packaging and delivery label where the item arrived damaged or incorrect.
We may ask you to retain the product and packaging while the matter is investigated.
Where goods are faulty, damaged, incorrect or misdescribed, we will provide the remedy required by applicable consumer law. Depending on the circumstances, this may include:

A refund;

A repair;
-
A replacement;
-
A price reduction; or
-
Another appropriate remedy agreed with you.
We will not charge a restocking fee or administration fee for a valid return involving faulty, damaged, incorrect or misdescribed goods.
Where we require such goods to be returned, we will provide an appropriate return method or reimburse reasonable return costs agreed with us in advance.
9. Damage During Delivery
Where a parcel appears visibly damaged at delivery, please photograph:

The unopened parcel;

The shipping label;
-
The damaged packaging;
-
The product inside the packaging; and
-
Any visible damage to the product.
Do not dispose of the packaging until we confirm that it is no longer required for the investigation.
Failure to contact us immediately does not automatically remove your statutory rights, but prompt notification helps us investigate the matter with the delivery provider.
10. Products Excluded from Change-of-Mind Cancellation
The statutory change-of-mind cancellation right may not apply to certain categories of goods, including:

Goods made to your specifications;

Clearly personalised products;
-
Goods liable to deteriorate or expire rapidly;
-
Sealed goods that are not suitable for return for genuine health-protection or hygiene reasons once unsealed;

Sealed audio, video or computer software products once unsealed;
-
Newspapers, periodicals or magazines, except qualifying subscription contracts;
-
Goods that become inseparably mixed with other items after delivery; and
-
Other products excluded by applicable law.
Depending on the specific product, this may include certain:

Personalised gifts;
-
Perishable foods;
-
Opened beauty or personal-care goods;
-
Opened hygiene-sensitive goods; or
-
Special-order products made specifically for the customer.
A product will not be treated as non-returnable merely because it is described as such. Any exclusion will only be applied where it is legally applicable to that particular product and circumstances.
This exclusion does not remove your rights where a product is faulty, damaged, unsafe, incorrect or misdescribed.
11. Food, Consumable and Perishable Products
Food, beverages and other products liable to deteriorate or expire rapidly may be excluded from the statutory change-of-mind cancellation right.
For safety and quality reasons, we may be unable to accept a returned consumable product once it has been opened, used, tampered with or stored outside the required storage conditions.
This does not affect your rights where the product was faulty, unsafe, damaged, expired when supplied, incorrectly supplied or not as described.
12. Beauty, Personal-Care and Hygiene-Sensitive Products
Sealed products that are not suitable for return for health-protection or hygiene reasons may become non-returnable once the seal has been broken.
This exclusion will only be used where the product genuinely qualifies for the legal health-protection or hygiene exception.
This does not affect your rights where the goods are faulty, damaged, incorrect, unsafe or misdescribed.
13. Electrical Goods
Electrical products returned under the change-of-mind cancellation right must not be used beyond what is reasonably necessary to inspect their nature, characteristics and basic functioning.
All supplied components, accessories, manuals, cables, plugs and packaging should be returned where available.
Where an electrical product is alleged to be faulty, we may reasonably inspect or test the product before confirming the appropriate remedy.
This does not affect your statutory rights.
14. Sale and Clearance Products
Sale and clearance products are not automatically excluded from returns.
Qualifying goods bought online remain subject to applicable statutory cancellation rights, and all goods remain subject to statutory rights relating to satisfactory quality, fitness for purpose and correspondence with their description.
Any additional voluntary return arrangement offered by us may differ for clearance or final-sale products, but it will not restrict your statutory rights.
15. Gift Cards
Gift cards and other monetary-value vouchers may be excluded from our voluntary return arrangements once supplied or used.
Any applicable statutory rights will depend on the nature of the gift card, how it was supplied and whether it has been used.

16. Exchanges
We do not guarantee direct exchanges.
The most efficient method is generally to return the original product in accordance with this policy and place a separate order for the replacement product.
Where we agree to an exchange, availability is not guaranteed until the replacement order has been processed.
If a replacement product has a different price, the difference may need to be paid or refunded as appropriate.
17. Items Returned Without Contacting Us
We request that customers contact us before sending a return so that we can provide instructions and associate the parcel with the correct order.
A failure to contact us first will not automatically invalidate a statutory cancellation where the customer has otherwise clearly exercised the cancellation right within the required period.
However, unidentified or unauthorised parcels may take longer to process.
The parcel should include:

Contact information; and

The reason for return or a copy of the cancellation notice.
18. Refused and Uncollected Deliveries
Refusing delivery or failing to collect a parcel does not always constitute a clear cancellation.

Where an order is returned to us because:

An incorrect or incomplete address was supplied;

Delivery was repeatedly attempted;

The parcel was not collected; or
-
Delivery was refused without prior cancellation,
we will assess the circumstances before processing any refund.
Where legally permitted, actual return-carriage costs or losses caused by incorrect customer-provided information may be deducted. No deduction will be made where the failed delivery resulted from our error or the delivery provider’s failure.
19. Orders Returned to Sender
If tracking shows that an order has been returned to us, contact bismillahgiftcentre33@gmail.com.
We will investigate why the delivery failed and determine whether the appropriate outcome is:

Redelivery;

Cancellation;
-
A refund; or
-
Another agreed resolution.
Additional delivery charges may apply where redelivery is required because the customer supplied an incorrect address or failed to collect the parcel.
20. Business Purchases
This policy primarily addresses purchases made by individual consumers for purposes wholly or mainly outside their trade, business, craft or profession.
Different contractual terms may apply to wholesale, trade or other genuine business-to-business purchases.
Any business return conditions, including any separately agreed restocking charge, must be expressly agreed before the business purchase is completed.
Nothing in this section limits rights that cannot lawfully be excluded.
21. International Orders
Consumer cancellation and return rights may differ depending on the destination country.
Where mandatory consumer law in the customer’s country provides rights that cannot lawfully be excluded, those rights will continue to apply.

Unless required otherwise by applicable law or agreed by us, international customers are responsible for:

22. Proof of Purchase

Acceptable proof may include:

23. Statutory Rights
Nothing in this policy limits or excludes your statutory consumer rights.
